 John L. Turner, Jr. works with businesses and individuals faced with difficult legal problems of any size. In addition to successfully resolving those problems, Mr. Turner seeks to develop a meaningful and trusted partnership with his client's by understanding their business operations, challenges, and values.
Practicing in both state and federal courts, Mr. Turner has substantial experience at the trial and appellate levels. A dedicated trial attorney, Mr. Turner has represented his clients as lead counsel in trials before jurors and the bench. Mr. Turner has also served as lead appellate counsel before both Texas and federal appellate courts. Mr. Turner is admitted to practice in all Texas state courts, the United States District Courts for the Eastern, Northern, Southern and Western Districts of Texas, and the U.S. Court of Appeals for the Fifth Circuit.
Mr. Turner formerly served as the judicial law clerk to the Honorable John McBryde of the United States District Court for the Northern District of Texas. Prior to his legal career, Mr. Turner was a Legislative Aide to U.S. Senator Kay Bailey Hutchison, and served in the United States Army for three years as an enlisted infantryman. Trial & Appellate Practice
- As lead trial counsel in week-long federal jury trial, successfully defended real estate developer against multi-million dollar securities fraud claims under the Securities Exchange Act of 1934, Rule 10b-5 and the Texas Securities Act.
- As lead counsel to former employee and current employer in covenant-not-to-compete litigation, persuaded state district court to deny employer's application for temporary restraining order.
- Obtained $2.5 million arbitration award as second-chair arbitration counsel in management consultant dispute.
- Skilled at all facets of pre-trial practice, including drafting and responding to written discovery, defending and taking oral depositions, drafting of dispositive motions, oral argument before court, attendance at hearing and pretrial conferences, and the drafting of trial materials, including jury charges, voir dire, judgments as a matter of law, and directed verdicts.
- Drafted Appellants' brief-in-chief and reply brief to U.S. Court of Appeals for the Fifth Circuit in negligence action against large national bank.
Commercial Litigation
- Successfully represented limited liability company member as lead attorney in breach of fiduciary duty litigation.
- Represented real estate developers and investors in various commercial disputes, including claims asserted against lenders, former and current partners, tenants, and contractors.
- Represented large national bank holding company in numerous lawsuits arising under Articles 4 and 4A of the Uniform Commercial Code.
Employment Litigation
- Obtained dismissal on the pleadings on behalf of apparel manufacture for claims arising under the Civil Rights Act of 1866, 42 U.S.C. § 1981, and various sections of the Employee Retirement Income Security Act, 29 U.S.C. § 1332, et seq.
- Experienced representing employers in matters arising under Title VII of the US Civil Rights Act of 1964.
White Collar Crime & Government Investigations
- Represented private investors in connection with investigations conducted by the Securities and Exchange Commission
Energy Litigation
- False Claims Act qui tam litigation involving the validity of oil & gas leases and lease payments.
