Ms. Rush's practice expertise covers a broad array of commercial litigation in both state and federal courts, including appellate practice, commercial disputes, slander and defamation, title and trespass claims, intellectual property, labor and employment, fraud, contract disputes, and insurance defense and prosecution.

Appellate

  • Won appeal of ruling on unenforceability of oral agreement to extend statute of limitations.
  • Successfully opposed petition for writ of certiorari to United States Supreme Court on issue regarding rule construction.
  • Renders appellate advisory opinions for all stages of trial including jury charges, preservation of error, and post-trial motions.
  • Numerous ongoing interlocutory and post-judgment appeals on issues including special appearances, contract interpretation, summary judgment rulings, charge error.
  • Served as Briefing Attorney for the Texas Court of Criminal Appeals.

Intellectual Property Litigation

  • Won federal summary judgment on prosecution of plaintiff's copyright infringement claim regarding lighting fixture knock-offs.
  • Successful settlement of trademark and copyright claims on behalf of luxury department store.
  • Successful settlement of trademark claims regarding knock-off of exclusive line of hand bags.
  • Successful defense of trademark cancellation action for major beer brand before United States Patent and Trademark Office.
  • Ongoing litigation including copyrights to commercials and software source code.

Title and Trespass Claims

  • Achieved permanent injunction against the City of San Antonio and telecommunications company on behalf of real estate developer for violation of restrictive covenant.
  • Prosecution of plaintiff's suit to remove cloud on title to minerals against major Texas energy company.
  • Title insurance matters including breach of policy and misrepresentation.

Commercial and Employment Litigation

  • Won numerous federal jurisdictional dismissals and venue and non conveniens transfer motions.
  • Contract disputes, private equity and inventment industry disputes.
  • Successful prosecution and settlement of business partner separation disputes.
  • Part of trial team in successful jury trial prosecuting business disparagement and defamation claims.
  • Federal and state employment matters, including: Title VII, the Age Discrimination in Employment Act, the Family Medical Leave Act.
