Rachel D. Ziolkowski’s practice is focused on the defense of management in all areas of employment and labor. She has been Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization since 2003.
Counseling and Investigations
Rachel's practice includes counseling employers on a variety of issues, including handbook and policy reviews, hiring, firing and counseling employees, the handling of requests for disability accommodation and medical leave, compliance with federal and state employment laws, and wage and hour compliance. Rachel also represents employers in local and federal agency matters, including matters before the EEOC, the Texas Workforce Commission and the Department of Labor. Rachel also provides services to employers related to the drafting and enforcement of employment agreements such as non-competition, non-disclosure, and non-solicitation severance agreements.

Litigation
An experienced litigator, Rachel’s litigation experience includes matters dealing with claims of various kinds of discrimination, harassment, and retaliation claims under federal and state law. Rachel also has extensive experience representing employers and individuals in wage and hour claims including FLSA collective actions. Rachel also represents individual companies in the prosecution and defense of misappropriation of trade secrets and breaches of non-disclosures, non-solicitations, and non-compete agreements. Rachel also conducts investigations for clients regarding EED issues including claims of sexual harassment and statutory compliance with the FLSA, OSHA, wage and hour and record keeping issues.
Rachel is a frequent speaker on a number of employment and labor law topics, including labor unionization avoidance, sexual harassment and diversity training. She also provides training to supervisors and employees on a variety of employment issues.
Ms. Ziolkowski earned her law degree from the University of Houston Law Center, and her undergraduate degree, with honors, from the University of Houston's Conrad N. Hilton College of Hotel & Restaurant Management. She joins the firm from Jackson Lewis LLP in Dallas.
