Dave Wishnew is an experienced trial lawyer that pursues and protects his clients’ interests with zealous advocacy. Dave maintains a diversified practice with a focus in complex commercial and employment litigation matters in state, federal, and administrative courts. Dave has a wide range of experience in litigating allegations of misappropriation of trade secrets, breach of contract, breach of non-compete agreements, discrimination, deceptive trade practices, fraud, tortious interference, breach of fiduciary duty, conversion, civil conspiracy, and shareholder oppression. Dave represents individuals, small businesses and large corporations in a variety of industries.

Dave was recently named a “Rising Star” by Texas Monthly and Law & Politics magazines, recognized by his peers as one of the top young lawyers in Texas.

Representative Experience

Labor and Employment

  • Successfully represented employers and employees in cases involving claims of breach of covenants not to compete and nonsolicitation agreements, breach of fiduciary duties, and misappropriation of trade secrets, including two recent cases where opposing plaintiffs dismissed claims without any financial recovery.
  • Successfully defended Fortune 500 corporation against allegations of federal discrimination laws.
  • Represented New York corporation against claims of age discrimination from Texas employee who dismissed claims for nominal settlement.
  • Represented state agency in arbitration against labor union.
  • Successful defense of local oil and gas company against discrimination claims before the Equal Employment Opportunity Commission and Texas Workforce Commission.
  • Experienced in the negotiation and drafting of employment agreements and severance agreements.
  • Counsel employers on variety of issues, including handbook and policy reviews, hiring and termination, disability accommodation and medical leave, compliance with federal and state employment laws.

Commercial Litigation

  • Successfully defended former CEO of company against allegations of breach of fiduciary duty and misappropriation of trade secrets.
  • Secured a judgment on behalf of an information technology company in a breach of contract case after bench trial in federal court.
  • Obtained favorable settlement for a Seattle based software company on its claims of deceptive trade practices and fraud against Texas based software company.
  • Obtained favorable settlement in defense of large international corporation in multi-million dollar breach of contract case.
  • Secured jury verdict in favor of landlord in dispute with tenant, obtaining all relief sought including full award of attorneys fees.
  • Obtained judgment declaring mechanic's lien invalid and unenforceable, clearing client's title to real property on business development.
  • Secured summary judgment on behalf of a large utilities company in multiple breach of contract suits.
  • Defended individual against a large corporation on claims of breach of contract, and obtained dismissal of lawsuit.
  • Lead associate in trademark infringement suit where court granted injunctive relief sought by client.
  • Earned judgments for a Fortune 500 telecommunications company on claims for damage to business property.
  • Successfully representation of principal shareholders and companies in corporate oppression cases.
  • First Chair Jury and Bench trial experience.
  • Post judgment enforcement and collection.
  • Experienced in alternative dispute resolution, including mediation and arbitration.
